No Discussion of Existence of Debt With Third Parties

Any debt collector communicating with any person other than the consumer for the purpose of acquiring location information about the consumer shall not state that such consumer owes any debt. See Section 804(2) of the Fair Debt Collection Practices Act, reproduced here for illustration purposes only.

Discussion of Debt With Other Creditors Prohibited

A portion of the FTC Official Staff Commentary on the Fair Debt Collection Practices Act reproduced here for illustration purposes only, includes the following : "A debt collector may not refer to the consumer's debt in any third party communication seeking location information, including those with other creditors."
