Character, Legal Status Or Amount Of Debt

A debt collector may not use any false, deceptive, or misleading representation or means in connection with the collection of any debt. Without limiting the general application of the foregoing, the false representation of the character, amount, or legal status of any debt is a violation of this section. See Section 807 (2) of the Fair Debt Collection Practices Act reproduced here for illustration purposes only.

False Statement That Suit Filed, Demanding More Than Owed

Also see a portion of the FTC Official Staff Commentary reproduced here for illustration purposes only. A debt collector may not falsely imply that legal action has begun, demand an amount more than actually owed, or falsely assert that debt has matured or is now due and payable, when it is not.
