Sale Or Transfer Permits Prohibited Or Illegal Acts

A debt collector may not use any false, deceptive, or misleading representation or means in connection with the collection of any debt. Section 807 (6)(B) prohibits the false representation or implication that a sale, referral, or other transfer of any interest in a debt shall cause the consumer to become subject to any practice prohibited by this subchapter. Referral Back To Creditor To Avoid Fair Debt Compliance

A portion of the FTC Official Staff Commentary on the Fair Debt Collection Practices Act reproduced here for illustration purposes only, includes the following :

"A debt collector may not falsely state that the consumer's account will be referred back to the original creditor, who would take action the FDCPA prohibits the debt collector to take."
