False Or Deceptive
Means To Collect Or Obtain Information
A debt collector may not use any false, deceptive, or misleading representation or
means in connection with the collection of any debt. Section 807
(10) prohibits the use of any false representation or deceptive means to collect or
attempt to collect any debt or to obtain information concerning a consumer. See Section
807 (10) of the Fair Debt Collection Practices Act reproduced here for illustration purposes
only.
This Prohibition
Is Very Comprehensive
A portion the FTC Official Staff Commentary on Section 807
(10) of the Fair Debt Collection Practices Act reproduced here for illustration purposes
only, includes the following: "The prohibition is so comprehensive that violation
of any part of section 807 will usually also violate subsection (10). Actions that violate
more specific provisions are discussed in those sections."
