Shaming Consumers Into Payment Prohibited
A portion of the FTC Official Staff Commentary on the Fair Debt Collection Practices Act reproduced here for illustration purposes only, includes the following:
"These provisions are designed to prohibit debt collectors from "shaming" a customer into payment, by publicizing the debt. "
Prohibited Actions Not Limited To Listed Examples
Section 806 of the Fair Debt Collection Practices Act prohibits a debt collector from engaging in any conduct the natural consequence of which is to harass, oppress, or abuse any person in connection with the collection of a debt. It provides examples of harassment or abuse. However, prohibited actions are not limited to the six subsections listed as examples of activities that violate this provision.
