Civil Liabililty. Section 813 imposes
actual damages, discretionary penalties, costs and attorney fees, and provides factors for
courts to consider in assessing damages. It also forgives an unintentional violation, for
those collectors who maintain reasonable procedures to avoid such violations. Section 813
permits actions to be brought in federal or state courts within one year from violation.
