LAWDOG Fair Debt Collection Practices Act

Definitions In The Fair Debt Collection Practices Act

LAWDOG is intended to assist in the understanding of basic concepts. See Disclaimer. Always obtain legal advice from legal professionals.

The Fair Debt Collection Practices Act, unlike many of the other Federal consumer protection acts, contains very few term definitions. Eight definitions contained in Section 803 are reproduced in this section. While few in number, these definitions are certainly important to an understanding of the Act. For example, the definition of "debt" is key to understanding that the act may apply only to certain transactions involving consumers. The term "consumer" indicates that the protection of the Act does not extend to corporations or partnerships, but only to a "natural person." A thorough understanding of each of these terms will prove to be useful in understanding the application of the Fair Debt Collection Practices Act.
