Natural Person Obligated or Allegedly Obligated To Pay Any Debt

As used in this subchapter the term "consumer" means any natural person obligated or allegedly obligated to pay any debt. This means that a corporation or other entity cannot be a consumer. See Section 803 (3) of the Fair Debt Collection Practices Act reproduced here for illustration purposes only.

A portion of the FTC Commentary On the Fair Debt Collection Practices Act reproduced here for illustration purposes only, includes the following: "The definition includes only a "natural person" and not an artificial person such as a corporation or other entity created by statute."

"Consumer" Defined For Purposes of Section 805

For the purposes of Section 805 0f the Fair Debt Collection Practices Act, the term "consumer" includes the consumer's spouse, parent (if the consumer is a minor), guardian, executor, or administrator. Section 805 covers communications with the consumer and third parties, and rules concerning "ceasing" communications.
