| Title and Registration Change
For Used Vehicles Application for certificate of
title and registration is made through one of the 105 County Treasurers Offices,
in county where vehicle is garaged. County treasurer issues
certificates of vehicle titles, registers vehicles, issues license plates, and collects
fees. |
| Registration and License Plates
Expire Upon the transfer of any registered vehicle, the registration
of the vehicle and the right to use any license plate thereon expires and the registration
may not be transfered, and the license plate must be removed by owner. It is unlawful for
any person, except person to whom originally issued, to have possession of license
plates. |
| Apply for Registration Within 30
Days The new owner must, within 30 days, inclusive of weekends and
holidays, from date of such transfer, apply for registration of the vehicle. Vehicle may
be operated on any highway in the state during the thirty-day period only
with application and issuance of temporary registration
from the county treasurer or from a dealer. After the thirty-day period, it is unlawful
for any other person to operate the vehicle unless the vehicle has been registered
as provided. |
| Registration Requires Title
No vehicle required to be registered shall be registered or any license plate or
registration decal issued unless owner or agent applies upon a division form and presents
satisfactory evidence of ownership with application for original certificate of title for
vehicle. |
| Only a duplicate title may be issued for vehicle with
unreleased lien or encumbrance, unless holder of lien consents in writing on approved
form. The certificate of title includes an assignment form of title to be signed by owner
before notary public or officer of oaths. See Kansas Statutes 8-135 |

| Perfection of Security Interests
In every sale of a vehicle subject to a purchase money security interest, the dealer or
secured party, within 15 days of the sale and delivery, must mail or deliver the notice of
security interest, together with fees to the division. The notice of security interest is
retained by division until it receives application for certificate of title to vehicle,
and a certificate is issued. The certificate of title will indicate any security interest
in vehicle. Upon issuance of this certificate, the division mails or delivers confirmation
of receipt of notice of security interest, date the certificate of title is issued and
security interest indicated, to the secured party at the address shown on otice of
security interest. The proper completion and timely mailing or delivery of a notice of
security interest by a dealer or secured party shall perfect a security interest in the
vehicle described on the date of such mailing or delivery.
The county treasurers mail a copy of the title application to lienholder. Each county
treasurer shall charge the lienholder a service fee for processing and mailing a copy of
the title application to lienholder. It is unlawful to operate in Kansas a vehicle
required to be registered, or to transfer title to any person or dealer, unless a
certificate of title has been issued as provided. See Kansas Statutes 8-135 |
| Kansas Uniform Commercial Code
and Perfection A security interest in a vehicle or mobile home
(except inventory held for sale), which requires indication on title of security
interests in the vehicle or mobile home can be perfected only by presentation for filing,
of the appropriate documents and payment of required fee to or acceptance of the documents
by such public official, or by the mailing or delivery by a dealer or secured party to the
appropriate state agency of a notice of security interest as described by Kansas Statutes
8-135. Such perfection has same effect as filing under the Uniform Commercial Code.

| Vehicle Dealer Defined
"Vehicle dealer" includes person engaged in the business of buying, selling or
offering or attempting to negotiate a sale of an interest in vehicles for commission,
money or other thing of value. May exclude certain receivers, trustees, persons acting
under supervision of a court, or any bank, trustee or lending company or institution
subject to state or federal banking or lending regulations, for disposition of repossessed

| Dealers Licensed and Supervised
by Director of Vehicles No person may engage in business of vehicle dealer
unless such person has complied with the applicable Kansas law. The director issues
licenses provided for by this act and has supervision over licensees in respect to all the
provisions of this act. Certain dealers in small trailers and qualifying charitable
organizations may be exempt for specified cercumstances. See Kansas Statutes 8-2403 |
| Display and Use of Dealer
License Plates Licensed manufacturer of or dealer in vehicles may be
issued special "dealer plates" for use, in lieu of registration, for
demonstrating, displaying or exhibiting such vehicles. See Kansas Statutes 8-136 |
| Reporting storage and unclaimed
vehicles Businesses which garage, repair, park or store vehicles for
public, in which a vehicle remains unclaimed for thirty (30) days, must report the vehicle
as unclaimed within five (5) days after that period. A vehicle left by owner whose name
and address are known is not "unclaimed". Penalties for failure to report a
vehicle as unclaimed. See Kansas Statutes 8-113a |
