Liability of Maker of a "Worthless Check": Kansas law (K.S.A. 60-2610 & 60-2611) permits the holder of a "worthless check" to recover the amount of the check, restricted mailing cost, service charges, and collection charges including, but not limited to, reasonable attorney fees. It also allows the recovery of treble damages in an amount not less than $100.00 and not more than $500.00 if a written demand is made to the maker of the worthless check at least 14 days prior to the filing of a civil lawsuit.
