| Fair Debt Collection Practices: There is no particular statute in the State of Kansas governing debt collection practices. However, Chapter 50 of the Kansas Statutes provides extensive coverage on Unfair Trade and Consumer Protection. In particular, the Kansas Consumer Protection Act (K.S.A. 50-623 et seq.) prescribes limitations on liabilities of consumers, and penalties for violation of the provisions under this Act. In general, waivers of a consumer's rights or benefits under this Act is unenforceable. (K.S.A. 50-625.) Also see K.S.A. Section 16a-5-107, which makes extortionate extensions of credit, as defined, unenforceable. |
