Transfer Requires Title If owner transfers interest in a vehicle other than by creation of a security interest, owner must, at time of delivery of vehicle, execute assignment and warranty of title to transferee, state actual selling price, and for vehicles subject to odometer law requirements, must state true cumulative mileage if known, and otherwise comply. Owner must cause the certificate and assignment to be delivered to transferee immediately. See 168A.10
Buyer Applies For New Title Except as provided in section 168A.11, transferee must, within ten days after assignment to transferee of certificate, execute application for new certificate of title on the certificate, and cause the certificate of title to be mailed or delivered to the department. See 168A.10
Notice To New Secured Party If a security interest is reserved or created at time of transfer, a notification of security interest is delivered or mailed to person who becomes secured party. See 168A.10
Compliance May Remove Liability   With limited exceptions and between the parties, a transfer by an owner is not effective until compliance with this section. But an owner who has delivered possession of vehicle to transferee and has complied, or within 48 hours after such delivery does comply, with this section by acts such as delivery of executed certificate, is generally not liable as owner for any damages resulting from operation of vehicle after the delivery of vehicle to transferee. See 168A.10

Retail Installment Contracts Regulated "Retail installment contract" means any agreement, entered into in state, evidencing a retail installment sale of motor vehicle, other than for resale, when purchased primarily for personal, family or household use, pursuant to which title to, or a lien upon motor vehicle is retained by the retail seller as security for retail buyer's obligation.
"Retail installment contract" does not include installment sale of motor vehicle purchased primarily for use in business.   "Business" means a commercial or industrial enterprise carried on for purpose of active or passive investment or profit. See Minnesota Statutes 1998 Section 168.66 .
 
Dealer Licensing Top
New Car Dealers No person may engage in the business of selling new motor vehicles without acquiring a new motor vehicle dealer license. A new motor vehicle dealer licensee is entitled to sell, broker, wholesale, or auction and solicit and advertise the sale, broker, wholesale, or auction of new motor vehicles. See Minnesota Statutes Section 168.27 Motor vehicle dealers
"Dealer" includes licensed new motor vehicle dealers, used motor vehicle dealers, motor vehicle brokers, wholesalers, auctioneers, lessors of new or used motor vehicles, scrap metal processors, used vehicle parts dealers, and salvage pools
Used Vehicle Warranty Every used motor vehicle sold by a dealer is covered by an express warranty which the dealer must provide to a consumer. The minimum terms to be included in express warranty are listed in Minnesota Statutes section 325F.662 covering the sale of used vehicles.
