Court System

The Mississippi court system consists of the Supreme Court, Court of Appeals, Chancery Courts, Circuit Courts, County Courts, and Justice Courts. The courts having jurisdiction over credit and collection matters are generally the Circuit Courts, County Courts, and Justice Courts.


Justice Courts: All cases with an amount in controversy not exceeding $2,500.
County Courts: All cases with an amount in controversy not exceeding $75,000.
Circuit Courts: All cases with an amount in controversy above $20,000.


Each of these courts requires the payment of a fee when an action is filed, the amount of which varies from county to county. An example of these filing fees are:

Justice Courts: $25.00 plus $5.00 for each additional defendant.
County Courts and Circuit Courts: Ranges from $90.50 to $100.00 plus $25.00 for Sheriff's fee and $1.00 for each additional defendant at the same address.
