Registration and Plates Required With limited exceptions, no person may operate a motor vehicle upon public highways of Montana unless the vehicle is properly registered and is conspicuously displaying proper number plates on front and rear of vehicle. Certain trailers, motorcycles, and vehicles authorized to display demonstrator plates may have one plate conspicuously displayed on rear of vehicle. Numbers are assigned by county of permanent residence at time of application for registration.  It is unlawful to use license plates issued to one vehicle on any other vehicle, trailer, or semitrailer unless legally transferred as provided by statute. Transfer Requires Signed Certificate When there is a transfer of any interest in a registered motor vehicle, the person whose interest is to be transferred must sign with pen and ink on certificate of ownership, and signature must be acknowledged before a county treasurer or deputy, department employee, notary or other person authorized to acknowledge signatures. See Montana Statutes Section 61-3-201
Buyer Must File Within 20 Days  Within 20 calendar days after signing of certificate, transferee must forward endorsed certificate of ownership with odometer statement, if required under 61-3-206, certificate of registration, together with information required under 61-3-202, to the county treasurer, who forwards them to the department. Certificates of ownership or registration are not issued until outstanding certificates are surrendered or their loss is established to  reasonable satisfaction of department. Penalties for failure to apply within 20-day grace period. See Montana Statutes Section 61-3-201
Secured Party May Intervene If buyer does not make application within 25 days, a creditor or secured party may pay fees for transfer of title and filing of security interest or lien in order to have title transferred to transferee (buyer) and have the security interest or lien filed. The creditor or secured party is not liable for penalty, registration fees, or taxes. The department must return certificate of title to the county treasurer. The treasurer holds the certificate of ownership until vehicle is properly registered. See Montana Statutes Section 61-3-201
Registrant Is Presumed Owner For the purpose of this section, with limited exceptions provided by 61-3-701(3), the person appearing on the public records as the registrant of any motor vehicle shall prima facie be deemed the owner thereof. See Montana Code Section 61-3-105

Dealer Must File Application For Dealer's License  A verified application for licensure as a dealer or wholesaler must be filed in the department by each person, firm, corporation, or association that, for commission or profit, engages in the business of buying, selling, exchanging, taking for consignment, or acting as a broker of new motor vehicles, recreational vehicles, used motor vehicles, trailers, semitrailers, mobile homes, or special mobile equipment as defined in 61-1-104, or business as a wholesaler as defined in 61-1-319.
