Bad Checks: Issuing and passing a bad check may be a criminal offense under the laws of Nebraska, and may subject the violator to fines, imprisonment, and be ordered to make restitution to the payee. There is generally a presumption that the writer of a bad check has knowledge that he did not have sufficient funds in or credit with the drawee for payment of the check unless, within ten days (10) after receiving notice of a dishonored check, he makes voluntary restitution to the payee for the value of the check plus ten dollars ($10) and reasonable service charges. (Section 28-611.)
