Court System
The court system in the State of New Hampshire consists of the Supreme Court, Superior
Court, District Court and Municipal Court. Credit and collection matters are
generally determined by the Superior Court and District Court. Superior Court: The superior court has jurisdiction of all civil actions except as those jurisdiction which is specifically conferred to the district courts or other courts by statute. ( §491:7.) District Court: All district courts have original and exclusive jurisdiction of all civil action involving money claims in which the amount in controversy does not exceed $1,500, and the plaintiff or defendant resides within the district; and have concurrent jurisdiction with the superior court of civil actions for money claims in which the amount in controversy does not exceed $25,000 and the plaintiff or defendant resides within the district where such court is located. A defendant may, within five (5) days of entry of action requests the transfer of any action, the damages of which exceeds $1,500, to the superior court. (§502-A:14.) Small Claims Court: Small Claims Courts are divisions of the district or municipal courts, and adjudicate actions involving money claims, exclusive of interest and costs, in amounts not to exceed $2,500. If the amount in controversy exceeds $1,500, either the plaintiff or the defendant may demand a jury trial. ( §503:1, et seq.) |
