| Title Requirements Oregon law provides an offense of violating vehicle title requirements involving owning or operating a vehicle in Oregon for which the state of Oregon has not issued title. Exemptions from title requirements are listed in Oregon Revised Statutes 803.030. Title from state may not be required unless vehicle is operated on Oregon highway, or operated under an Oregon registration number. See Oregon Revised Statutes 803.025 | ||
| Delivery of Certificate When a certificate of title is issued by Oregon, unless otherwise provided by law, the Department of Transportation delivers the certificate to security interest holder with highest priority. If there are no security interest holders, the Department delivers to a lessor. If there are no security interest holders or lessors, the certificate of title is delivered to owner of vehicle. | Registration Required Oregon law provides an offense of failure to register a vehicle involving ownership of a vehicle in the state and without registering the vehicle in Oregon. This section also applies to out-of-state corporations maintaining a place of business in state, with regard to vehicles that are used by the corporation doing business in the state. There are exemptions from this section listed in Oregon Revised Statutes 803.305. See Oregon Revised Statutes 803.300 | ||
| Exclusive Manner of Perfection Except for vehicles held by dealer as inventory, the exclusive means for perfecting a security interest in a vehicle is by an application for notation of security interest on the title. The application may accompany application for title, or may be made separately at any time prior to issuance of title. See Oregon Revised Statutes 803.097 | ||
| Notice of Transfer Required Except as otherwise provided in section, transferor of interest in a vehicle covered by Oregon title must notify Department of Transportation of the transfer within 10 days of date of transfer. The notice must be on department form and must contain sufficient description of vehicle to identify it, name, address and date of birth of transferee. The notice also includes drivers license number and signature of transferee, and other information required by department. See Oregon Revised Statutes 803.112 | ||
| By Operation of Law For notice under this section, if transfer occurs by operation of law, the receiver, trustee, sheriff or other representative or successor in interest of person whose interest is transferred, is considered to be transferor. Rules specifically not applicable to creation, termination or change in a security interest or leasehold interest, or upon award of ownership of motor vehicle made by court, and those by vehicle dealers in many transactions. | Vehicle Dealers Must Be Licensed
Oregon law includes an offense of acting as a vehicle dealer without a
certificate, where the person is not the holder of a valid, current vehicle dealer
certificate issued under ORS 822.020 and person buys, sells, brokers, trades or exchanges
vehicles either outright or by means of conditional sale, bailment, lease, security
interest, consignment or otherwise, displays a new or used vehicle, trailer, semitrailer
or manufactured structure for sale, or acts as any type of agent for the owner of a
vehicle to sell the vehicle or acts as any type of agent for a person interested in buying
a vehicle to buy a vehicle. Presumption This section does not apply to persons or vehicles exempted from this section under ORS 822.015, including the owner of a vehicle as shown by vehicle title issued by any jurisdiction if person owned vehicle primarily for personal, family or household purposes. A person who has sold, traded, displayed or offered for sale, trade or exchange more than five vehicles in one calendar year, has the burden of proving that person owned the vehicles primarily for personal, family or household purposes or for other purposes which Department of Transportation defines as exempt.
