Court System:

Actions to determine the validity of debts are generally within the jurisdiction of the Circuit Court and Magistrate Court in the State of South Dakota.
 

A. Magistrate Court: This court is a division of the Circuit Court and has jurisdiction over all small claims cases with an amount in controversy not exceeding $8,000.00.
 
B. Circuit Courts: All actions involving an amount in controversy in excess of $8,000.00 are within the Circuit Courts' jurisdiction.

The filing fees to commence an action are generally as follows:
 

Magistrate Courts: (Section 15-39-52.)
 
Claim amount of $100.00 or less $ 4.00
Claim amount $100.01-1,000.00 $10.00
Claim amount $1,000.01- $8,000.00 $20.00
 
 
Circuit Courts: $25.00. (Section 16-2-29.)
