Title Application To County Clerk Every owner of a vehicle subject to registration for which no certificate of title has been issued by Tennesee Motor Vehicle division, is required to make application to county clerk of county where vehicle is to be registered, for issuance of a certificate of title for vehicle on approved forms. Each application must bear signature of owner in pen and ink, and contain name, bona fide residential street address, number or route and box, mailing address of owner or business address, description of vehicle including, insofar as may exist and apply to a given vehicle, odometer reading, make, model, body, serial number of vehicle, engine or other number, and if new vehicle, date of sale to person intending to operate. See Tennessee Code Section 55-3-103
Application form also requires statement of applicant's title and of all liens or encumbrances upon vehicle, names and addresses of all persons having any interest, nature of such interest, and such further information as may reasonably be required by division to determine whether owner is entitled to a certificate of title. If department is not satisfied as to ownership of vehicle or security interests, department may require applicant to file bond.  When application is for new vehicle purchased from a dealer, application must be accompanied by statement by dealer or a bill of sale showing any lien retained by dealer and manufacturer's certificate of origin. See Tennessee Code Section 55-3-103
Perfection Subject To Acceptance The county clerk of the county where vehicle is to be registered, acts as the agent of the division in receiving the application for certificate of title pursuant to this section. By receiving such application, the transfer of title, and any liens noted thereon shall be deemed perfected, subject only to action by motor vehicle division in declining, for good cause shown, to issue title or to note such lien thereon. Title May Be Held By Lienholder   Upon receipt of application for a certificate of title, and after determining by examination of its records that the applicant is entitled to a certificate of title, the Tennesee Motor Vehicle division issues the same. The certificate of title is delivered to owner in event no lien or encumbrance appears thereon. Otherwise, the certificate of title is delivered to person holding the first lien upon vehicle as shown in certificate, and is to be retained by holder of first lien until the lien is discharged. See Tennessee Code Section 55-3-114
Satisfaction of Lien At time that lien is satisfied, a notation is to be made on certificate of title, setting forth fact that the lien has been discharged, which is signed by lienor. The lienor must then deliver certificate of title to owner within seven (7) business days from owner's request, unless certificate of title shows on face one (1) or more liens still outstanding, in which event certificate of title must be delivered to next prior lienor, either in person or by registered mail. The lienor must also within seventy-two (72) hours notify the division of discharge of such lien by registered mail with return receipt demanded. As used in this subsection, "owner" includes any person or entity who lawfully acquires a motor vehicle and pays off the outstanding lien or encumbrance on such vehicle. When License Required   It is unlawful for any person to engage in business as, or serve in capacity of, or act as a manufacturer, distributor, factory branch, distributor branch, factory representative, distributor representative, motor vehicle dealer, motor vehicle salesperson or automobile auction without first obtaining a license as required in this chapter. See Tennessee Code Section 55-17-109
