Court System:
The court system in West Virginia consists of the Supreme Court of Appeals, Circuit
Court, County Magistrate's Court, County Commissions and Court of Claims. Credit and
collection cases are generally determined by the Circuit Court and County Magistrate's
Court.
- Circuit Court: The Circuit Court has original and general
jurisdiction of all matters at law where the amount in controversy, exclusive of interest,
exceeds $300. (51-2-2.)
County Magistrate Court: The County
Magistrate Court has jurisdiction of all civil actions wherein the value or amount in
controversy or the value of property sought, exclusive of interest and cost, is not more
than $5,000. (50-2-1.)
