 Collection Agency Licensing Requirements:

Collection agency licensing requirements are governed under the Collection Agency Act of 1973 of the State of West Virginia.  (§47-16-1 et seq.)  A collection agency must first apply for and obtain a business franchise registration certificate pursuant to §11-12-2 of the West Virginia Code, and file with the State Tax Commissioner a continuing surety bond of $5,000.  In addition, debt collection agencies must also comply with the provisions of the West Virginia Consumer Credit and Protection Act (§46A-1-101 et seq.), and secure a proper business license from the West Virginia Tax and Revenue Department.
